The privacy of your personal information is important to Early Bird Alert, Inc. To protect your privacy, we provide you with our Privacy Policy so that you will understand our commitment to you and to your privacy. This Privacy Policy describes what information we may collect about you; how we use your information; how we protect it; and what choices you have about how that information is used. At Early Bird Alert, Inc., we understand that health is a very personal, private subject, and we want you to feel as comfortable as possible when you interact with us.

As our privacy policy changes in significant ways, we will make every effort to notify you of the changes. Minor changes to the policy may occur that will not affect our use of individually identifiable or personal health information. When the privacy policy changes in a way that significantly affects the way we handle personal information, we will not use the information we have previously gathered without providing notice or obtaining your consent when appropriate. We will post privacy policy changes on our Web sites in a timely manner.

The following makes up our Privacy Policy. We hope that reading it gives you a clear idea of how we manage information regarding you.

Our Commitment to Your Privacy

Early Bird Alert, Inc. is strongly committed to protecting your privacy. This Privacy Policy discloses what information we gather and how we gather it, how we use it, how and to whom we disclose personal and other information we have collected. This Privacy Policy applies to information collected by Early Bird Alert, Inc. and its affiliated companies, service providers, Partners, advertisers and affiliates (collectively, “us”, “we”, “our” or the “EBA Network”) By providing your information to us or a Partner or using any of our equipment, sites or engaging any of our services, offerings or features (the “EBA Network Components”), you agree to the terms of this Privacy Policy and our Terms of Service.

We have implemented technology and security policies, rules, and other measures to protect the personal data that we have under our control from unauthorized access, improper use, alteration, unlawful or accidental destruction, and accidental loss. We also protect your information by requiring that all our employees and others who have access to or are associated with the processing of your data respect your confidentiality.

We use security methods to determine the identity of each registered user, so that appropriate rights and restrictions can be enforced for that user. Reliable verification of user identity is called authentication. Early Bird Alert, Inc. uses both passwords and usernames to authenticate users. Users are responsible for maintaining their own passwords.

Information We Collect

When you register for any EBA Network Component, we will ask for personal information needed to permit you to enjoy access all EBA Network Components. The confidential personal information may include your first and last name, a street address, telephone number, email address, your social security number, or various other data which allows the tracking of a user. Personally identifiable information can include date of birth, height, weight, etc., medical conditions, and medications when this information is recorded and stored online by EBA in combination with one of the above identifiers. EBA may also collect information about your preferences, satisfaction, behavior, purchasing habits, product attributes and other likes, dislikes, interests, attitudes and behaviors (along with demographic information from you and other sources). All of this information helps us provide you with the EBA Network Components and deliver, evaluate and improve the effectiveness of the EBA Network Components.

From time to time we may augment our existing user databases with legally obtained information from third parties. Some of this information may be personally identifiable, such as national change of address information. We do this to better target our information offerings and promotional campaigns and to provide pertinent offers in which we think you would be interested.

We may target our marketing messaging depending on information we have about you. For example, a user we know is a woman may receive information on products targeted at women that a male user will not see. We may send information to you that we may believe will benefit you.

Information Sharing

We may share your information only with third party entities we have selected to provide our services, features or offerings to Users of the EBA Network, or that support EBA’s operations or the operations of vendors to such third parties. Our contracts with these third party entities will require them to keep any personally identifiable information strictly confidential, and allow them to use any information only to offer the contracted services to EBA and Users of the EBA Network. Contracts with these third party entities will require them to comply with any HIPA laws, rules and regulations. Some of these third party entities may pay EBA a fee for access to our EBA User list, personal information and medical, statistical, behavior or demographic information.

We may share non-personally identifiable information in the form of aggregated statistical and demographic based data, reports and/or findings to third parties for marketing, advertising, or other uses.

We may release account and other personal information when we believe release is required to comply with law. We may release personal health information if, in our judgment after review by an attorney, the release is compelled by law or regulation, or if the release may be necessary to prevent the death or serious injury of an individual.

We may also release your information when we believe release is appropriate to enforce our site policies, or protect ours or others rights, property, or safety.

We do not sell or rent personal information to telemarketers, mailing list brokers, or any other companies that are not offering EBA-endorsed services or benefits.

When we share information with third parties working on behalf of Early Bird Alert, Inc., we use our best efforts to assure that they agree in writing to abide by our privacy policies.

If we discover that a third party working on behalf of Early Bird Alert, Inc. inappropriately disclosed personal information about any of our visitors, we will take immediate action to prevent further occurrences.

How We Protect Your Information

We implement a variety of security measures to maintain the safety of your personal information when you use any of our sites or engage any of our services, offerings or features or enter, submit, or access your personal information.

We use a secure server. All supplied sensitive and personal information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our gateway provider’s database only to be accessible by those authorized with special access rights to such systems, and who are contractually required to keep the information confidential.

After you provide us with any information it shall be kept by us to improve the EBA Network services provided to our Users and provide third parties with research, purchasing and product behavior and other information.

Personally identifiable health information you share with us is stored on our database servers at EBA data centers or hosted by third parties who have entered into agreements with us that require them to observe our Privacy Policy. We have a firewall and other technology to prevent individuals from accessing information without authorization. Data centers are designed to be physically secure and protected from unauthorized access by unauthorized persons.

Information in our data centers is backed up routinely, in order to aid in the recovery of information in the event of accidental damage of information or due to a natural disaster. The backup media is stored in a physically secure storage facility.

We Use Cookies

Cookies, log files, and pixel-tags (Web beacons) are technologies used by the EBA Web sites to identify a user as the user moves through our Web sites. Your browser allows us to place some information (session based IDs and/or persistent cookies) on your computer’s hard drive that identifies the computer you are using. We may use cookies to personalize our Web sites and to track your usage across other EBA Web sites.

We use cookies to understand and save your preferences for future visits, keep track of provided advertisements, and compile aggregate data about site traffic and site interaction so that we can offer better site experiences, features, and tools in the future.

Your Web browser can be set to allow you to control whether you will accept cookies, reject cookies, or to notify you each time a cookie is sent to you. If your browser is set to reject cookies, Web sites that are cookie-enabled will not recognize you when you return to the Web site, and some Web site functionality may be lost. The Help section of your browser will tell you how to prevent your browser from accepting cookies.

Although cookies do not normally contain personally identifiable information, if you have provided us information about you, we may associate your registration information with cookies or other tracking utilities our Web site places on your computer’s hard drive. Associating a cookie with your registration data allows us to offer increased personalization and functionality. Without cookies, this functionality would not be possible.

On occasion, we contract with third parties to place cookies on your computer’s hard drive. These third parties have entered into an agreement with us that requires them to observe our Privacy Policy. We may provide third parties with certain information you provide in order to assist us in better understanding our site visitors. These service providers are not permitted to use your information except to help us conduct and improve the User’s site experience and our business.

Some of our business partners may use cookies on our sites (for example, links to business partners). We do not want our business partners to use cookies to track our customers’ activities once they leave our sites. However, we may not have total control over how our business partners may use cookies on our Web sites. If you become aware that an EBA business partner is placing an unwanted cookie on your hard drive, please contact our Privacy Officer to assist us in resolving the problem.

In addition, we may use other tracking systems like pixel-tags. Pixel tags, sometimes called Web beacons, are similar in function to a cookie. But because of their insignificant size, it is not visible; though, they are used to pass certain information to our servers to personalize our Web sites and to track your usage across other EBA Web sites. In addition, we may also use pixel tags in our HTML based emails.

Third Party Links

At our discretion we may include or offer third party products or services, and link to their websites, through the EBA Network Components. However, even if a third-party affiliation exists between the EBA Network and that destination site, the EBA Network exercises no authority over linked sites, each of which maintains independent privacy and data collection policies and procedures. The EBA Network assumes no responsibility or liability for these independent methods or actions and is not responsible for the independent policies or procedures of destination sites. Similarly, the EBA Network cannot take responsibility for the privacy initiatives or the content of such sites. These destination links are provided only for your convenience, and as such, you access them at your own risk. Nonetheless, we seek to protect the integrity of the EBA Network Components and welcome any feedback about third party offerings or linked sites.

We may contract with other companies and individuals to help us provide services. For example, we may host some of our Web sites on another company’s computers, hire technical consultants to maintain our Web sites, or work with companies to remove repetitive information from customer lists, analyze data, provide marketing assistance, and provide customer service.

In order to perform their jobs, these other companies may have limited access to some of the personal information we maintain about our users. Other companies may collect information on our behalf through their sites. This occasionally incorporates the use of frames on the site that will not show the URL you are visiting in the browser address window. We require such companies to comply with the terms of our privacy policies, to limit their access to any personal information to the minimum necessary to perform their obligations, and not to use the information they may access for purposes other than fulfilling their responsibilities to us. We use our best efforts to limit other companies’ use of personally identifiable or health care information.

California Online Privacy Protection Act Compliance

Because we value your privacy we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. Except as we otherwise have mentioned herein, we will not distribute your personal information to outside parties without your consent.

As part of the California Online Privacy Protection Act, all users of our site may make any changes to their information at anytime by calling EBA Customer Service at 1-855-385-9274.

Updating your Information

You can always contact us in order to (i) remove the personal information that you have provided to us from our systems, (ii) update the personal information that you have provided to us, and (iii) change your preferences with respect to marketing contacts by emailing us at privacyofficer@earlybirdalert.com or if available also logging into your account to update your information.

Your Privacy Choices

We respect your privacy choices.

Sometimes we send offers to selected groups of customers. To accomplish this we may use third parties working on behalf of EBA. We provide a variety of mechanisms for you to tell us you do not want to receive such promotional – informational offers. For example, we may provide an opt-in box for customers to receive information that is sent by a third-party fulfillment house, and we make clear that, by opting in, you are submitting your data to a third-party. You can elect not to receive promotional or informational material from us by following the instructions to opt-out as mentioned or included in each of our programs we send to you.

You will be given the opportunity to choose whether your personal information is (a) to be disclosed to a third party working with EBA or (b) to be used for a purpose that is different from the purpose originally intended or authorized. In addition, for sensitive information that includes personal information specifying medical or health conditions, you will be given an affirmative or explicit opt-in choice.

If you do not want us to share your information with third party entities, you can refuse to provide the requested information and you will not be able to receive the service provided by the EBA Network.
